Fanon is a platform for fanfiction and original works by fans.
Our principles or What we believe
When you post content to Fanon, you retain whatever ownership rights you had to begin with. These Terms of Service (“Terms”) will continue to evolve in response to feedback from our community and stakeholders. Transformative works are legal and covered under fair use. Fair use is the right to make some use of copyrighted material without getting permission or paying. We aim to make each of these documents including our Terms and Privacy Policy readable. Fanon (“Fanon”, “Company”, “We” or “Us” and their connotations) operates a website (URL: https://www.fanon.co/) (“Platform”). Our Platform is primarily engaged in providing an online platform for its users to upload and consume fanfiction and original literary works.
These Terms describe the terms on which the Company grants Users access to the Platform (hereinafter referred to as “Services”) and shall be read with the privacy policy available on fanon.co/privacy-policy The users of the Platform are herein referred to as “You”. The term “Users” for the purposes of these Terms shall be read as You.
People below 13 years old are not allowed to use this Platform without parental consent, and any person below the age of 13 years availing the Services shall be deemed to have obtained parental consent to do so.
License to Use
Company hereby grants you the limited right to access, view and use the Platform only for the purposes of viewing and uploading fanfiction and original literary works. Any rights not expressly granted to you herein are reserved to the Company.
In order to fully access the Platform, you will need to register an account, by choosing an account name, and setting a password.
You shall be responsible for all the activity on your account, and for keeping your password confidential. If you share your account information with anyone, that other person may be able to take control of the account, and we may not be able to determine who is the proper account holder. We shall not have any liability to you (or anyone you share your account information with) as a result of your or their actions under those circumstances.
Restrictions
You must comply with the laws that apply to you in the location that you access the Company’s Services from. If any laws applicable to you restrict or prohibit you from using the Services, you must comply with those legal restrictions or, if applicable, stop accessing and/or using the Services, and the Company shall not be liable for such non-compliance on your part. You promise that all the information you provide to Company on accessing and/or using the Services is and shall remain true, accurate and complete at all times.
Notwithstanding anything, you are specifically restricted from all of the following:
publishing any Platform material in any other media, without the Company’s prior written consent; selling, sublicensing and/or otherwise commercializing any Platform material, without the Company’s prior written consent; publicly performing and/or showing any Platform material, without the Company’s prior written consent; using this Platform in any way that is or may be damaging to this Platform; using this Platform in any way that impacts any other user’s access to this Platform; using this Platform contrary to applicable laws and regulations, or in any way may cause harm to the Platform, us or to any person or business entity; engaging in any data mining, data harvesting, data extracting or any other similar activity in relation to this Platform;
Fanon maintains the right to reserve access to certain areas of the Platform based on its sole discretion.
Any user ID and password you may have for this Platform are confidential and you must maintain confidentiality as well.
User Content and Intellectual Property Rights
In these Terms, “User Content” shall mean any audio, video, text, images, or any other material you choose to display on this Platform. You own all the rights to the User Content you create and post on this Platform. By displaying User Content, you grant us a non-exclusive, worldwide irrevocable, sub licensable license to use, reproduce, adapt, publish, translate, and distribute it in any and all media.
User Content must be your own and must not be invading any third-party’s rights. We reserve the right to remove any User Content from this Platform at any time without notice.
Other than the content you own, under these Terms, We and/or our licensors own all the intellectual property rights and materials contained in this Platform.
We have adopted a policy toward copyright infringement on the Services in accordance with the Indian Copyright Act, 1957, the Digital Millennium Copyright Act (“DMCA”), and the applicable rules formulated thereunder. While our policy is based on the aforementioned laws, we apply this same policy globally to all jurisdictions in which our Services are available. If you’d like to submit a claim of copyright infringement, please write to us at info@fanon.co. We reserve the right to remove content alleged to be infringing without prior notice, at our sole discretion, and without liability to you or anyone else. In appropriate circumstances, we will also terminate a User’s account if the user is determined to be an infringer.
We may come across websites that have illegally scraped content from us. When we find these sites we do our best to have them shutdown. In order to act on behalf of our Users, we need to have your legal permission to do that so we ask for it here when you sign up. You authorize us to act as your agent to issue take down notices in accordance with the applicable legislation that allows for the submission of requests to Internet service providers and any other person involved in the illegal posting for the removal of infringing or allegedly infringing copyright materials that are contained in or displayed on such service providers platforms and/or services.
All content, whether publicly posted or privately transmitted, is the sole responsibility of the User who originated such content. We may not monitor or control the content posted via the Platform and we cannot take responsibility for such content. We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any content or communications posted via the Platform or endorse any opinions expressed via the Platform. You understand that by using the Services, you may be exposed to content that might be offensive, harmful, inaccurate, or otherwise inappropriate, or in some cases, postings that have been mislabelled or are otherwise deceptive.

This Platform and the Services provided are on an “as is” basis. The Company, its licensors and affiliates make no representations or warranties of any kind (express, statutory, or implied) as to the operation of the Platform, provision of Services or the information, content, materials, or products included on the Platform, or in association with the Services or any third-party websites or services. The Company will not be held responsible for any unethical, illegal acts performed by the Users and the action of each of the Users shall be their own responsibility solely.
The Company disclaims any and all warranties, express or implied, including, but not limited to, implied warranties of merchantability, quality of service and fitness for a particular purpose and shall not be responsible for any loss of data, loss of profits or any kind of misuse (statutory or otherwise) by any of its Users individually or during their interaction with each other. Except as provided above, there are no other warranties, conditions or other terms and conditions, express or implied, statutory, or otherwise, and all such terms and conditions are hereby excluded to the maximum extent permitted by law.
Limitation of liability
In no event shall the Company, nor any of its officers, directors, and employees, be held liable for anything arising out of or in any way connected with your use of this Platform, whether such liability is under contract. The Company, including its officers, directors and employees shall not be held liable for any indirect, consequential, or special liability arising out of or in any way related to your use of this Platform.
Indemnification
You hereby indemnify to the fullest extent the Company and its officers, directors, employees and agents from and against any and/or all liabilities, costs, demands, causes of action, damages and expenses arising in any way related to your use of the Platform or breach of any of the provisions of these Terms.
Severability
If any provision of these Terms is found to be invalid under any applicable law, such provisions shall be deleted without affecting the remaining provisions herein.
Variation of Terms
The Company is permitted to revise these Terms at any time as it sees fit, and by using this Platform you are expected to review these Terms on a regular basis.
Assignment
The Company is allowed to assign, transfer, and subcontract its rights and/or obligations under these Terms without any notification. However, you are not allowed to assign, transfer, or subcontract any of your rights and/or obligations under these Terms.
Entire Agreement
These Terms read along with our Privacy Policy constitute the entire agreement between the Company and you in relation to your use of this Platform, and supersede all prior agreements and understandings.
Termination
Company may remove, restrict, cancel, or suspend access to and/or use of the Service and any part of it, if Company considers (in the sole discretion of Company) that You have breached any of these Terms.
You may also terminate your agreement with Company by ceasing to access the Service, deleting all copies of the Service or part thereof within your control. Termination shall not affect any rights or remedies, which have accrued up to the time of termination.
Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the Indian Arbitration and Conciliation Act 1996, or such similar laws of India, which are not in conflict with each other. Such shall be subjected to the exclusive jurisdiction of the competent courts of Bangalore, India.
